These Terms and Conditions apply to all services and resources offered by Neurobalance Clinic, including appointments, programs, courses, guides, tools, and downloadable materials. Please read them carefully before booking, purchasing, accessing, or using any part of this website or its offerings.

1. Scope
These Terms & Conditions (“Terms”) apply to all products and services offered by Neurobalance Clinic, including BrainTap programs, PEMF sessions, NeuralChek HRV Assessments, combined programs, workshops, and BrainTap headset sales. By booking or purchasing, clients acknowledge they have read and agree to these Terms.
2. Program Structure
a. Programs currently offered include:
I. Structured Reset Program: Consultation and Assessment appointment, followed by the remainder of a 20-session BrainTap program, with NeuralChek HRV assessments used at baseline, midpoint, and final stages. The Consultation and Assessment appointment includes the first BrainTap session.
II. Dual-Tech Recovery Program: Consultation and Assessment appointment, followed by the remainder of a BrainTap and PEMF program, with NeuralChek HRV assessments used at baseline, midpoint, and final stages. The Consultation and Assessment appointment includes the first BrainTap session. After this appointment, the program includes 19 PEMF sessions stacked with the remaining BrainTap sessions.
III. Family Calm Program: Consultation and Assessment appointments are booked together for both participants, unless otherwise agreed in writing by Neurobalance Clinic. Each participant’s Consultation and Assessment includes their own NeuralChek HRV assessment and first BrainTap session. The primary participant completes a 20-session BrainTap program with NeuralChek HRV assessments at baseline, midpoint, and final stages. The secondary participant completes a 10-session BrainTap program with NeuralChek HRV assessments at baseline and final stages.
b. The Consultation and Assessment appointment forms the baseline stage of the program. This appointment includes a pre-session NeuralChek HRV assessment, a BrainTap session, and a post-session NeuralChek HRV assessment, followed by consultation regarding results, suitability, and recommended scheduling.
c. Midpoint and final HRV assessment appointments are used to review progress and inform any adjustments to the treatment schedule where appropriate.
d. Session frequency is guided by clinical judgment, client goals, and best-practice scheduling, informed by NeuralChek HRV data where relevant. Schedules may range from more intensive short-term support to a steadier weekly format.
e. Programs must be completed within the timeframe advised at intake, unless otherwise agreed in writing by Neurobalance Clinic.
3. Payments & Payment Plans
a. The Consultation and Assessment appointment is booked and paid for directly through Neurobalance Clinic at the time of booking.
b. If the client chooses to proceed with a program after the Consultation and Assessment, Neurobalance Clinic will issue an invoice for the remaining program balance, with the Consultation and Assessment fee credited toward the total program cost.
c. Once the client has confirmed their program and paid the invoiced amount, sessions will be scheduled and managed through the MindBody Lounge booking system.
d. Payments for Neurobalance Clinic services may be made by bank transfer where offered, or via Stripe. Stripe fees, where applicable, are non-refundable and may be added on top of the invoiced amount.
e. Headset sales: Neurobalance Clinic is an affiliate partner of BrainTap Technologies, Inc. Headsets are purchased directly through BrainTap Technologies, Inc. and are subject to their terms and conditions of sale.
f. Clients who purchase through Neurobalance Clinic’s affiliate link receive access to Neurobalance Clinic support services and the Resource Library, but all headset transactions, payment plans, warranties, and returns are managed directly by BrainTap Technologies, Inc.

4. Refunds, Credits & Deferrals
a. The Consultation and Assessment is a standalone paid appointment. If a client attends this appointment and then decides not to proceed with a program, the Consultation and Assessment fee is not refunded. If the client proceeds with a program, the Consultation and Assessment fee is credited toward the total program cost.
b. Neurobalance Clinic does not offer refunds for change of mind, including where a client decides not to proceed with a program after booking or after the Consultation and Assessment has been completed, subject always to any rights the client may have under Australian Consumer Law. 
c. If a client cannot continue a program due to health reasons, changed suitability, or another circumstance accepted by Neurobalance Clinic, Neurobalance Clinic may, at its discretion, offer a credit for the unused portion of the program rather than a cash refund. Any approved credit expires six months from the original program payment date.
d. Where a client has commenced a program and then chooses not to continue for reasons other than major failure or rights arising under Australian Consumer Law, any refund or credit remains at the discretion of Neurobalance Clinic and may take into account services already provided, including assessments, consultations, and completed sessions.
e. For major failures with a service, clients may have rights under Australian Consumer Law, including cancellation of the service contract and a refund for the unused portion, or compensation for reduced value. Nothing in these Terms excludes, restricts, or modifies any rights under Australian Consumer Law.
f. Because access to the online course is provided immediately after purchase, payments are final and refunds are not offered for change of mind, subject always to any rights under Australian Consumer Law.

5. Cancellations, Missed Sessions & Expiry
a. Consultation and Assessment appointments must be cancelled or rescheduled at least 24 hours before the appointment time. Cancellations or rescheduling requests made within 24 hours, and missed Consultation and Assessment appointments, may result in the loss of the booking fee, subject always to any rights under Australian Consumer Law. 
b. Once a program has commenced, missed sessions or no-shows without notice count as used sessions unless otherwise agreed in writing by Neurobalance Clinic.
c. Programs must be completed within the timeframe advised at intake and documented as part of the client’s treatment schedule. As a guide, intensive or higher-frequency schedules may be completed over a shorter period, while steadier schedules may run over a longer timeframe. Neurobalance Clinic will advise the expected completion window at commencement.
d. If more than six weeks elapse between sessions, re-testing is required before the program can continue, unless otherwise agreed in writing by Neurobalance Clinic.
e. Credits approved for unused sessions or the unused portion of a program expire six months from the original program payment date.

6. Re-Testing Fee
a. Programs paused for longer than six weeks require re-testing to ensure valid data and program safety.
b. Re-testing fee: $195 (covers new NeuralChek assessment and apparatus session).
7. Warranty & Returns (BrainTap Headsets)
a. Neurobalance Clinic is an affiliate partner of BrainTap Technologies, Inc.
b. All headset purchases, payment plans, warranties, and returns are handled directly by BrainTap Technologies, Inc. under their terms and conditions of sale.
c. Neurobalance Clinic provides support services and access to the Resources Library for clients who purchase through our affiliate link but is not responsible for the financial transaction or warranty process.
8. Health & Medical Disclosures
a. Neurobalance Clinic services are complementary and non-medical; they are not intended to diagnose, prevent, or treat medical conditions.
b. Clients must disclose all relevant health conditions at intake and confirm they are medically fit to participate. Where there is uncertainty, clients must seek clearance from a medical professional before commencing.
c. Contraindications and medical considerations (BrainTap):
i. Definite contraindications: photosensitive epilepsy, uncontrolled seizures, severe psychiatric instability.
ii. Medical clearance required before participation: brain injury or concussion, light sensitivity, certain neurological conditions, or use of medications that lower seizure threshold.
d. Contraindications and medical considerations (PEMF):
i. Definite contraindications: pregnancy, pacemakers, implanted medical devices.
ii. Medical clearance required before participation: active cancer, uncontrolled heart conditions, recent surgery, or other neurological conditions.
e. Contraindications and medical considerations (NeuralChek HRV assessments):
i. Definite contraindications: individuals with implanted cardiac devices (pacemakers, defibrillators).
ii. Medical clearance required before participation: unstable arrhythmias, uncontrolled cardiovascular disease, or recent cardiac events.
f. If a client’s medical condition changes during the course of a program (for example, new diagnosis, medication change, or surgery), it is the client’s responsibility to inform Neurobalance Clinic before continuing sessions so suitability can be reassessed.
g. If a client experiences any ill effects, discomfort, or adverse response during a session, they must immediately notify staff, and the session will be paused or ceased as appropriate. Further participation may be subject to medical clearance.
h. The responsibility for seeking medical clearance, both at commencement and if health circumstances change, lies with the client.
9. Privacy & Data
a. Personal and HRV/NeuralChek data is securely stored (password-protected) and accessible only by Lauren Rogers.
b. Clients may request a copy of their report. Raw HRV test data is not routinely shared and is retained securely for clinical and research purposes.
c. Clients may request deletion of identifiable data; anonymised data may be retained for research.
d. Data will not be shared with third parties except as required by law.
e. Neurobalance Clinic collects your personal information to process your purchase, provide access to the course, communicate course-related updates, and manage your participation. Your information will be handled in line with our Privacy Policy, and you can unsubscribe from non-essential emails at any time.
10. Stripe Fees & Payment Processing
a. Payments processed via Stripe incur a 1.7% + $0.30 fee for domestic cards (international rates vary).
b. Stripe fees are added on top of the program price and are non-refundable if a program is cancelled.
c. Bank transfer is available at no additional fee.
11. Workshops
a. Workshop bookings are subject to specific terms disclosed at the time of booking, which may vary by event.
12. Online Courses
a. Access to online courses is for the purchaser only, unless otherwise stated in writing by Neurobalance Clinic.
b. Course materials are provided for personal use only and must not be copied, shared, distributed, reproduced, or used for commercial purposes without prior written permission from Neurobalance Clinic.
c. Online courses and course materials are provided for general educational purposes only. They are not medical advice, psychological advice, or a substitute for individual professional care.
d. Neurobalance Clinic online courses are not a crisis or emergency service. If you need urgent medical or mental health support, please contact emergency services or an appropriate crisis support service.
13. Free Resources
a. Free tools, guides, and downloadable resources provided by Neurobalance Clinic are for general educational purposes only. They are not medical advice, psychological advice, or a substitute for individual professional care.
b. Free resources are intended to provide general information and practical support, but they are not tailored to your personal circumstances and should not be relied on as a diagnosis, treatment plan, or therapeutic service.
c. Neurobalance Clinic free resources are not a crisis or emergency service.
14. Acceptance
a. By paying for services or products, clients confirm they have read, understood, and agreed to these Terms & Conditions.
